If we mess up, we will try and put it right as soon as possible. If your not happy, contact us, we offer a 30 day no quibble returns policy.

Please read these terms and conditions carefully as they give information regarding the policies under which you will be ordering lenses with us. In these terms and conditions: “Vision Supermarket” means “www.visionsupermarket.com”. The terms “we” and “us” are to be construed as Vision Supermarket. Vision Supermarket is the trading name for Advante Medical Ltd.

1. TERMS & CONDITIONS OF USE OF WEBSITE

You are required, and we advise you, to read the terms and conditions of use of the website before using it for making any purchases. By placing an order with us you indicate that you have read and agreed with all the terms and conditions of use and you agree that you will act accordingly. If you do not agree with these terms and conditions then please do not use our website.

The information and services provided by the website are supplied by Advante Medical Ltd.

The allowance of using the service on our website is on a temporary basis and we reserve the right to withdraw or make changes to the service we provide without any notice. We will not be responsible if the website is unavailable at any time.

Occasionally we may deny access to some parts of the website to our users. For example, for those who are making a transaction with us for the first time completing a registration form is compulsory, otherwise this part of the website will not be available. However, you can edit and update your details within the My Account section as and when required.

We provide the best information and descriptions possible regarding our products on our website, although we do not wish our customers to solely rely upon the information provided to make their purchasing decisions. We cannot be held liable for any reliance placed on such information by any user.

Collection of personal information – Personal information is data which could identify or be used to contact an individual.

We store and use your personal information as and when needed in accordance with our privacy policy. By placing orders through our website you allow us to process your information and agree that all the information provided is true and accurate.

The information we collect may include, but is not limited to : Your name, email ID, address, phone number and debit/credit card information. We may collect information through our website, email phone and live chat.

We permit our users to download and print copy from the website only for their personal reference. Any changes made to the website or website copy, or any attempt at using the website material for commercial use, without our consent, is prohibited.

Users are informed not to input any material which is technologically harmful and may create functional problems for the website. All users are prohibited from gaining access to the private and administrative area of the website.

Any user found not abiding to these prohibitions will be reported to law enforcement agencies and relevant action will be taken against them.

We will not be liable for any damage caused to your appliance while using our website as this is usually an uncontrollable factor. However, we have taken necessary steps to avoid such accidents.

2. VALID PRESCRIPTION REQUIRED

You hereby certify that you hold a valid prescription for the contact lenses you wish to order. This means that your prescription was made within 12 months from the date of purchase and that the prescription has been dispensed by a professional and qualified optometrist or contact lens fitter (hereafter referred to as practitioner). We reserve the right to verify such details with your practitioner. The above statement also applies to customers re-ordering lenses. Where you have been given a contraindication to wear lenses by a registered practitioner we reserve the right to revoke any sale, unless otherwise redirected by the same or another registered practitioner. You hereby also state that you have no ailments that contraindicates the wear of lenses. When purchasing from us you confirm and verify that you have been prescribed the contact lenses you have ordered by a qualified practitioner, therefore we do not take responsibility if you order lenses that have not been prescribed for you and/or if the difference between the prescription and purchase date exceeds 12 months. We strongly recommend that regular eye checks be made by a qualified practitioner to ensure the welfare and continuity of your eye health. You do not have to send us your prescription but by accepting the terms and conditions contained herein you verify that you have a valid prescription that is valid within UK Law. The contact lens wearer must be at least 16 years old. We may assist you with your prescription if you so wish by emailing us on [email protected].

If you have selected to send your Contact Lens prescription to us after purchase, but you do not do so despite our reminders, we will refund your order and charge an admin fee of £5 to cover our time and merchant fees. This applies to prescriptions that also turn out to be invalid or expired.

3. OUR RIGHTS

We reserve the right to refuse to sell products to you if we believe that you have a motive of re-selling the product. We also have the right to control the quantity of products made available to you. We may terminate your contract with us and restrict your access to the website if we believe that any of your actions are in violation of any applicable law or are harmful to the interest of other users. We reserve the right not to supply contact lenses if we believe there are any health contraindications against the wear of lenses or if the contact lens specifications do not meet the satisfaction of the terms set herein. The General Conditions shall be in accordance with the law of the country in which the Supplier accepts the order and not from the country in which the distribution was executed. The sale contract will strictly be between the Supplier and the Customer. The Customer will represent the individual that executes a sale from the website and has read the terms and conditions accepting the contents in their entirety.

4. DEFINITIONS & MEANINGS

“Optical Appliance” means any optical system that is used or worn in conjunction with the eye. This includes spectacles (frames and ophthalmic lenses), contact lenses and lens glazes. These can be used to correct/aid eye anomalies.

“Dispensing Optician” is defined as an individual who fits and adapts optical appliances on the basis of a prescription derived from an ophthalmic optician or ophthalmic medical practitioner.

“Optometrist/Ophthalmic Optician” is an individual that is involved in the testing of sight under the governance of the Opticians Act 1989. They are allowed, under this act, to perform optical dispensation services for optical appliances after they have conducted an eye examination or they have been provided with details of refraction/lens fittings from another optometrist.

“Ophthalmic Medical Practitioner” is an individual who has extended their medical practice to specialise in the testing of sight, also under the guidance of the Opticians Act 1989, and can also provide optical dispensation services of optical appliances.

“Optical Dispensing Services” are provided by opticians (the definition of which is in these Terms & Conditions). Optical consultants, under direct supervision, can also provide the services as defined in the optical dispensing services definition. We can have in house opticians or subcontract optical dispensing services to opticians.

5. OPTICAL DISPENSING SERVICES

Vision Supermarket (Advante Medical Ltd) supplies/provides optical dispensing services. Consultations for dispensing services can be executed in several ways and include, but are not limited to, via our website, chat engines, emailing, verbally by telephone or mobile phone, or visiting our consultant for a face to face consultation.Vision Supermarket (Advante Medical Ltd) can or may also outsource consultations for dispensing services to other qualified professionals and/or contract a part of its entire services to a third party, whilst being obliged to adhere to the Terms and Conditions contained herein regarding all aspects of dispensation services to the optical appliances available on our site.

Vision Supermarket (Advante Medical Ltd) uses or subcontracts to qualified ophthalmic opticians (also known as optometrists) and/or ophthalmic medical practitioners (OMP) and/or dispensing opticians and/or contact lens fitters and/or contact lens/optometric consultants (under the guidance of a qualified optometrist/dispensing optician/OMP) to supply optical dispensing services and optical appliances. Collectively, we refer to the qualified individuals as said herein as “Opticians”. Vision Supermarket (Advante Medical Ltd) and/or its sub-contractors employ qualified ophthalmic optometrists and/or dispensing opticians (referred to in these Terms and Conditions as a “OO/DO” or “OOs/DOs”) who are also trained and qualified to fit and/or dispense optical appliances. All optical dispensing advice for the supply of optical appliances is done by opticians, with the term “Opticians” as defined in these Terms & Conditions. These Terms and Conditions are a strict agreement between the customer and Vision Supermarket (Advante Medical Ltd) for all optical dispensing services and supply/provision of optical appliances (including, but not limited to, contact lenses).

A Frame only order, is expected to be dispatched often the same day. Single vision prescriptions and fashion lenses are custom made and supervised by a Registered British Dispensing Optician and therefore are anticipated to dispatch in 1 week. Varifocals and Bifocals are highly specialised lenses and can take up to 2 weeks to dispatch.

6. PRICES AND PAYMENTS

The prices displayed on our website for all products will be the price you must pay when you order, unless subject to a promotional discount. However, there may be exceptions when price errors are displayed by mistake.

Prices displayed do not include delivery costs. The price of delivery will be shown when you order your items.

Optical dispensing services are charged at 35% of the price of prescription optical appliances (excluding VAT). This services charge is included in the total price of the optical appliances we dispense.

This dispensing charge covers optical advice and guidance. No dispensing charge is given for non-prescription optical appliances. This includes eye drops, contact lens solutions and other eye care products that are not contact lenses, sold on this website.

For customers based in the EU, all prices include VAT.

For customers based outside of the EU all prices shown will be displayed accurately and at full price.

The decision to change advertised prices of services and goods is that of Vision Supermarket and we may do this at any time without prior notice. If prices are changed, confirmed orders made before the change will not be affected. Orders submitted but not yet confirmed before the change may be affected.

If a product on our website is incorrectly priced when a customer orders, we have no obligation to sell the product at this price. We will contact the customer to notify them of the correction in price for their order. We will then either change the price if the customer agrees or cancel the order.

The customer will be entirely responsible for any import duties and liable for any breaches of laws and regulations in the country of delivery.

Payment must be made through Vision Supermarket’ chosen payment providers. These are Stripe, Paypal and other suitable secure providers.

Customers must have a valid credit or debit card to make a purchase on our website. We may change payment providers at any time.

When a payment method is entered but before the order is placed, a pre-authorisation charge for the full amount of the order may take place to ensure the card will allow full payment. If the order is not placed, the pre-authorisation charge will be removed in a few days; the duration will depend on the debit or credit card supplier.

The credit or debit card used will be charged at the time of order. The act of payment will not constitute a contract between Vision Supermarket (Advante Medical Ltd) and the customer. If, for any reason, the order is refused after payment, a refund will be given.

7. FORCE MAJEURE

We shall not be liable for the delay or failure to supply a product from our site as a result of events that are beyond our reasonable control. Should any such event occur, we shall endeavour to contact you to make a decision as to whether the contract of sale should remain or be revoked.

8. LIMITATIONS OF LIABILITY

We will not be responsible for any typing errors or mistakes that you have provided while placing your order.

It is the responsibility of the customer to enter true and valid details when registering an account with Vision Supermarket. In case of forgotten passwords, customers will be asked to enter their birthdate, as it was entered when registering. It is therefore advised that customers enter their own, valid birthdate when registering an account.

The customer can subscribe to receive Vision Supermarket marketing communications via email.Vision Supermarket communications may include new product information, special offers, competitions, or an invitation to participate in market research. Neither Vision Supermarket (Advante Medical Ltd) nor our trusted email service provider will give out personal data to third parties without the customer’s permission. Only if the customer gives their consent when registering an online account or signing up for the newsletter will they be sent third party emails.

The goods remain the property of the seller until such time that the goods and associated charges have been fully paid by the purchaser.

On completing the online order form you agree and accept that you are the person responsible for placing the order and agree for paying all the charges put through the website.

We reserve the right, at our discretion, to charge your credit card if we have shipped you an order and the invoice is not paid within a reasonable period of time.

We have the right to revise and amend these Terms and Conditions as and when we think it is required.

We will not be bound by your offer/purchase if there is an error in any advertisement or pricing that is on the website. In such circumstances the offer of purchase will be revoked.

Where the performance of delivery expectation falls short or there are any other such circumstances that hinder the performance of purchase to receipt of your goods, we will not be held responsible due to either uncontrollable circumstances or other errors herein mentioned. We will, however, endeavour to remedy such events to the best of our abilities.

The delivery of the products will be directed by your preference and you will also confirm and accept the associated charges of delivery. It will also be understood that the responsibility of the delivery will immediately be transferred from the seller to the purchaser once the products have left our point of pick up. Where a delivery date is not specified we will try and fulfil orders within 21 working days.

Any disputes directed to Advante Medical Ltd will be governed solely by British law.

Vision Supermarket strives to keep your personal information accurate. We have implemented technology, management processes and policies to maintain customer data accuracy. We take precautions to protect personal information that you have submitted on this site. However, we will not accept any liability for unauthorized theft or data that has been used to your detriment.

9. CANCELLATIONS & RE-ORDERS

9.1. CANCELLATIONS

Once placed, orders can only be cancelled on the same day of placing the order and before the cut off time of 3pm. Any requests made for cancellation after 3pm will not be accepted. If an order is placed after the cut off time (3pm), this will be considered as an order that has been placed on the following working day, the cut off time still being applicable. Working days are to be construed as Monday to Friday. UK bank holidays will not be considered as working days.

If you have missed the cancellation time you will be responsible for the return of the products at your own cost.

Kindly refer to the REFUND POLICY for details regarding the appropriate costs and times.

9.2. REORDERS

All users will be registered and provided an individual username and password, and our database will hold all relevant information regarding prescriptions.

You can reorder the same product as your last order, providing the prescription is valid within the terms as set out within. However, if you wish to order lenses with a different prescription or make of lenses you need to provide us with a new, valid prescription clearly stating that you have been advised to do so by a professional optometrist. Please refrain from placing a reorder in such circumstances.

10. DISCOUNT CODES & MARKETING PROMOTIONS

Where a discount or marketing promotion is offered it may be used at the checkout to receive a discount on the final price of products or, added automatically before the checkout. Unless otherwise stated, all delivery charges will be excluded from the discount. Discounts and marketing promotions can only be used once. You cannot use more than one discount or marketing promotion per transaction, therefore two or more discounts cannot be used in conjunction with each other, again, unless otherwise stated.

11. VISION SUPERMARKET AUTO REPLENISH SERVICE

By opting in to the Auto Replenish service, the customer authorizes Vision Supermarket to take payments according to their selected date interval, via their current payment method.

Only automated orders after opt-in will qualify for free delivery.

If payment for an Auto Replenish order fails to process, the order will not be placed. In this situation, a customer services advisor will contact the customer to verify and update their details.

We reserve the right to change the prices of our products and services at any time. If the price of a product in an Auto Replenish order changes, we will aim to notify the customer of the change before the next automated order is submitted and determine if the customer wishes to continue with the Auto Replenish order at the altered price.

The customer can opt out any time from this service. Customers can cancel Auto Replenish via their online account but must do at least 5 days before their next order is due.

12. PRICE MATCH GUARANTEE

Price match claims can only be made against like for like items. The item that is found to be cheaper must have the same features, prescription, quantity, name and packaging as the item sold by Vision Supermarket. Prices must be compared to the prices advertised on the Vision Supermarket website. We will not accept comparisons to Vision Supermarket items found on affiliate sites, shopping comparison sites or other third party websites.

We will also not accept price comparisons made from websites based outside the UK or in different currencies.

A price match claim can only be made before you purchase a contact lens product.

Price matches cannot be applied to any contact lens products listed in the Fashion Contact Lenses section.

The decision to award a price match and money off discount will be that of Vision Supermarket and we will only award such if we are satisfied with the claim.

All email and call claims are subject to a verification process by our customer services team at the time of receipt. If the product(s) in question cannot be verified as lower in price by our customer services team at the time of the claim then we will not award the price match discount.

The discount cannot be used in conjunction with any other offer or promotion.

Orders may be for 1, 3, 6 or 12 months’ supply of the chosen price match product. The discount stated will apply to the total price for the ordered supply.

Delivery charges will be exempt from the discount.

13. LOCATION OF SALE, JURISDICTION AND LAW

13.1. PLACE OF SALE

The place of all sale transactions of all products in this site will be from the UK.

13.2. GOVERNING LAW

The terms contained herein are governed by the law of the United Kingdom and all Contracts made with Advante Medical Ltd for the purchase of any Products will be duly governed under UK laws.

Any disputes arising from the purchase of products from Advante Medical Ltd will be directed by the courts of the UK, which will have exclusive jurisdiction on the purchase of Products from our Site.
